Yes, it is need it that the user who will be set as emergency access in your account settings have at least a Free version of LastPass. Without an account it won't be possible to claim the emergency account and access your information from there.

I can understand the need to validate them at the time of the emergency but I feel I should be able to nominate somebody ahead of time without them having to be a user today.

what is your suggested mechanism for estate planning and giving an executor access to ones account?
